BaseTrade Terms & Conditions of Use

The BaseTrade trading system is owned by Online Commerce Ltd. and operated on their website

Online Commerce Ltd. is a limited company whose registered office is at Unit 45, Rissington Business Park, Upper Rissington, Cheltenham, Gloucestershire. GL54 2QB.

Use of the BaseTrade system is permitted only where you agree to the latest terms and conditions as laid out on this page. These terms and conditions may be changed by us from time to time.

  1. Use
    1. Use of the BaseTrade system is at the discretion of Online Commerce Ltd. We reserve the right to reject any application for an account if we deem that it will be detrimental to the business or the users of the BaseTrade system.
    2. The use of the BaseTrade system is limited to those people that can lawfully enter into a contract under the laws of their respective countries.
    3. At all times, any content you create that is visible on the BaseTrade system must be courteous and polite. You must not use any nicknames, feedback comments, reviews, product descriptions, delivery messages or any other visible information that is obscene, discriminatory, offensive or discourteous.
    4. Use of the BaseTrade system requires that you register for an account and that you agree to abide by these terms and conditions.
    5. When creating an account you must provide true and correct information including your name, address, phone number, email, date of birth and payment card details.
    6. Unless specifically agreed by us in writing, all users of the BaseTrade system are limited to one account.
    7. A BaseTrade account has an associated nickname. This nickname cannot be a URL or representative of a URL. We reserve the right to reject a nickname if we deem it to be problematic in any way, such as, offensive or infringing on other parties rights.
    8. If you contravene these terms and conditions we reserve the right to terminate your account.
    9. We reserve the right to reject an application for a BaseTrade account at our sole discretion.
    10. We reserve the right to terminate your account immediately and without notice if you are in breach of these terms and conditions.
  2. Operation
    1. By using the BaseTrade system, you grant us and our affiliates a non-exclusive, worldwide, royalty-free right to exercise all copyright, database rights and rights of publicity over the material displayed in your listing or in any other catalogue or product information that you provide to us (excluding any of your logos, trademarks or other similar branding), in any existing media now or at any later date.
    2. The business relationship between BaseTrade and sellers is subject to VAT. It is your responsibility to research and determine your VAT obligations for your operation and country. BaseTrade requires a valid VAT identification number from EU sellers who are VAT-registered.
    3. BaseTrade provides and environment where a buyer and seller can deal with each other. BaseTrade is not a party to any transactions between a buyer and a seller and any contract concluded is solely the responsibility of the buyer and the seller.
    4. Should a dispute arise between buyer and seller, the buyer and seller should make all possible efforts to resolve the dispute and any correspondence should be made between the buyer and seller. BaseTrade is not obliged to enforce or to fulfil any contract or to mediate between buyer and seller.
    5. The BaseTrade system allows its users to rate and to leave feedback about its users. Any information left using the BaseTrade feedback system will be publicly visible. In signing up to the BaseTrade system you release us from any liability that may arise in connection with the publication of any comments about you.
    6. We reserve the right to terminate any listing that is in breach of our terms and conditions.
    7. We reserve the right to remove any inappropriate material including feedback, nicknames, branding or product listings.
    8. We do not guarantee continuous and uninterrupted access to BaseTrade and to our services.
  3. General Conditions
    1. The price of any items listed on BaseTrade must include delivery, any customs or excise duty, VAT and any other taxes that may be applicable.
    2. It is the responsibility of the seller to remit VAT and all other payments required on the sale of their goods.
    3. You must not use BaseTrade for any unlawful activity.
  4. Buyers Conditions
    1. Use of the BaseTrade system is facilitated via your account
    2. In order to purchase an item listed by a seller, we will make available to the seller your details which are relevant to the sale.
  5. Sellers Conditions
    1. You must review all activity on your BaseTrade account, and communication regarding BaseTrade, daily. You cannot rely on email as notification of an event.
    2. Sellers are not automatically able to sell in all categories. We reserve the right to restrict the categories that a seller can sell in.
    3. A seller must maintain a feedback rating above 90%.
    4. Listings must be accurately described and not misleading.
    5. You must dispatch all items sold within two business days of the sale being made.
    6. You are responsible for the successful delivery of items to the buyer and you are expected to obtain the suitable insurance from your delivery company in order to claim if an item goes missing.
    7. If your seller account balance becomes negative, we will make a charge against your registered payment card and we may make an additional administrative fee for this activity. It is your responsibility to make sure you have adequate funds in your seller account to cover any refunds you may need to make.
    8. Should an item listed on BaseTrade fail to sell after 60 days, we reserve the right to cancel the listing.
    9. You must list the same item and cannot list an alternative item against one of our listings.
  6. Disputes
    1. Buyers Conditions
      1. Should you have a dispute with a seller, you must contact the seller direct using the Contact Seller option beside the order details on your account.
      2. If you cannot resolve the dispute with the seller, you can then escalate the issue to us and we will investigate the transaction and the dispute with a view to resolving the dispute or making a refund.
      3. You are responsible for the safe return of an item if it is faulty or not as described by the seller.
    2. Sellers Conditions
      1. Should there be a dispute with a transaction, you must endeavour to resolve the dispute with the buyer directly.
      2. If a dispute is not settled agreeably between the buyer and the seller, and the buyer contacts us to escalate the problem, we will contact you for further information and to confirm that you have complied with these terms and conditions.
      3. If you have failed to comply with these terms and conditions, we will refund the buyer from the funds in your seller account.
      4. If you have complied with the terms and conditions the buyer's dispute will be rejected or the buyer will be refunded by us.
  7. Transfer of funds and fees
    1. All items sold on BaseTrade incur a fee, payable by the seller. The fee is charged at the point when the item is purchased.
    2. When a seller's item is purchased on BaseTrade, the funds for that purchase, minus any fees are recorded and are visible in your BaseTrade account.
    3. Money for your sales is transferred to your BaseTrade Seller Account, and available for withdrawal, 14 days after the sale is completed, enabling you to maintain a Reserve in your seller account against returns, customer claims and so on.
    4. We reserve the right to place an additional reserve on funds in your account if the operation of your account is not kept up to date or if we feel that activity on your account is unusual. This reserve will be released when any outstanding issues are resolved.
    5. You can request the withdrawal of funds from your BaseTrade seller account. The minimum withdrawal amount is £40.00.

    7. We can only make payments in GBP, British Pounds and we can only make payments to UK bank accounts.
